Terms of Use – Merchants

By using Kyvo, you unreservedly accept these Terms.

1. Purpose

These Terms of Use (the "Terms") govern access to and use of the Kyvo platform (the "Platform") by merchants (the "Merchant").

2. Services Provided

Create and customize digital loyalty cards
Award points to customers via a QR code or alternative code
Track rewards earned
Referral system
Sending notifications
Access to statistics
Access to sub-account services for employees
Client activity management
Access additional tools (analytics, communication, visibility)

3. Account Creation

The Merchant must provide accurate and up-to-date information at registration. Any incomplete, inaccurate, or fraudulent information may result in suspension or deletion of the account.

4. Service Communications

By using Kyvo, the Merchant accepts by default to receive service emails from Kyvo (updates, important information, maintenance, etc.).

5. Subscription and Billing

Access to Kyvo services is subject to a €15/month VAT-included subscription (after two free months), charged via our partner Stripe.
Payments are recurring and automatically renew each month.
The Merchant may cancel their subscription at any time from their account area.
In case of non-payment, Kyvo reserves the right to suspend access to the service.

6. Merchant Obligations

Use Kyvo in compliance with applicable laws
Do not fraudulently manipulate loyalty points or rewards
Respect customers’ rights (notably regarding personal data protection)
Do not use Kyvo for deceptive, unlawful, or unfair commercial practices

7. Kyvo's Responsibilities

Kyvo undertakes to provide a service consistent with its description, within reasonable technical means.
Kyvo cannot be held liable in case of misuse of the Platform by the Merchant
Kyvo is not liable for indirect damages (loss of revenue, reputational harm, etc.)
Kyvo is not responsible for redirects proposed by merchants in notifications
Temporary interruptions may occur for maintenance or service improvements

8. Termination

The Merchant may close their account and cancel their subscription at any time. Kyvo reserves the right to suspend or delete an account in the event of non-compliance with these Terms.

9. Intellectual Property

All elements of the Platform (texts, logos, graphics, software, etc.) are protected by copyright and remain the exclusive property of Kyvo.

10. Changes to the Terms

Kyvo may amend these Terms to reflect service changes or legal updates. Merchants will be informed of any material changes by email or via the Platform.
